Navigating OSHA's Expanded Worker Walkaround Rule

Description

The Occupational Safety and Health Administration (OSHA) unveiled a new rulemaking which goes into effect May 31, 2024, significantly expanding the scope of individuals who may participate in the walkaround phase of OSHA’s workplace inspections. For example, third parties who are not employees of the employer being inspected may be permitted to enter the workplace and assist OSHA in the inspection. If the workplace is a non-union facility, a representative of a union that does not represent the employees may be permitted to enter the workplace to assist OSHA in the inspection. This rule greatly expands who may participate in the inspection and has the potential to create disruption during the inspection and also increase the potential for citations. Mark Lies, Partner, Seyfarth Shaw LLP

Mark Lies has been practicing occupational safety and health law with Seyfarth since 1974. He has represented clients across the country, as well as in U.S. territories. His practice involves virtually every industry and has handled responses to a variety of workplace incidents, including catastrophic fires, explosions, and accidents.

Lie has represented clients in federal and state courts, on matters which have been landmark OSHA cases involving definitions of willful citations, search warrants, confined spaces, firefighting, heat illness, and others. He has also been invited to be a member of the industry associations that actually write industry safety standards, including the American National Standards Industry (ANSI) and the National Fire Protection Association (NFPA).

Adam Young, Partner Seyfarth Shaw LLP

Adam Young regularly assists clients with workplace safety counseling, regulatory counseling, OSHA litigation, commercial litigation relating to safety and health issues, and whistleblower litigation. Young helps employers with safety and health issues relating to drugs and alcohol in the workplace, with an emphasis on cannabis compliance and policies. He has experience in all aspects of labor and employment counseling and litigation, and guides employers through any legal issue.

Young is an accomplished trial lawyer and has successfully tried OSHA and other employment matters before federal and state courts. His trial work before the Occupational Safety and Health Review Commission (OSHRC) Commission judges, and OSHA state plan agencies has resulted in the vacating of OSHA citations and the creation of favorable case law for employers. He has also represented clients successfully at mediations and arbitrations. Young's pro bono work includes representing the parents of abducted children in federal litigation under the Hague Convention on the Civil Aspects of International Child Abduction. The U.S. Department of State, Office of Children's Issues awarded him a Certificate of Appreciation for his work on behalf of pro bono clients. Young was named Seyfarth’s 2016 Pro Bono Associate of the Year.

Young is proficient in Spanish and helps employers with investigations and workplace safety counseling related to Spanish-speaking employees.

Kristen Hildreth, AVP Government Relations and Strategic Partnerships, ReMA

Kristen Hildreth is the AVP of government relations and strategic partnerships for ReMA. In her role, she's poised to leverage her experience and network to foster strategic partnerships and advance and bolster ReMA’s policy priorities across all levels of government. Prior to joining ReMA, Hildreth demonstrated her advocacy skills at the National Conference of State Legislatures, a bipartisan national association representing the legislatures of the 50 states, territories and the District of Columbia. There she effectively lobbied Congress and the administration on behalf of states in the agriculture, energy, environment and transportation arenas. Her expertise includes identifying emerging policy issues, building coalitions and translating complex policy action into accessible insights for a diverse range of audiences. She holds a B.S. in political science from the George Washington University.
