Superfund Alert

ISRI has become aware that many members have recently received a letter from the United States Environmental Protection Agency (EPA) that is commonly referred to as a “104 (e) letter.” Such letters are sent by the EPA, under § 104 (e) of the Comprehensive Environmental Response, Contribution and Liability Act (CERCLA or Superfund), to any party they think may have information concerning the contamination of a particular Superfund site.

Anybody that receives a 104 (e) letter must respond to EPA or face significant penalties for not doing so.  It is frequently the case that if someone cannot respond within the stated deadline (30 days in this instance) that EPA will grant an extension.

This round of letters seeks information regarding the United Metals, Inc. Superfund site in Marianna, FL, which was a battery breaking operation.  The battery breaking operations took place at the site from 1979 to 1991, which means that most people who received the 104 (e) letter do not have records readily available, if at all.  Furthermore, we have yet to speak with anyone who even recognizes the name of the company in that location.  It is very possible that the batteries were bought in “blind transactions” where a broker directed the shipping company to deliver them to the United Metals, Inc. site after the batteries left the recycler’s facility.
